Introduction

Shin Nihon Kosan Inc. (d.b.a. Shogun Restaurant), together with its U.S. subsidiaries and affiliates that provide services under the name "Shogun Restaurant" ("Company", "we", "our", or "us") respect your privacy and are committed to protecting it in accordance with this policy. This policy describes how we collect, process, retain, and disclose personal data about you when you use our websites, newsletters, restaurants, or otherwise communicate with us (collectively, the "Services") and our practices for using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

• Through the Services.
• In communications, including email, text, chat, and other electronic messages, between you and the Services.
• When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children's and Minors' Data

Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 13. In some cases, a parent or legal guardian may voluntarily provide limited information about their child, such as a first name and birthday, in connection with reservations, events, Samurai Rewards, or birthday celebrations. We only collect this information from parents or legal guardians. We collect and use such information solely for the purpose for which it was provided and do not knowingly collect personal data directly from children without parental involvement. If we learn we have collected or received personal data directly from a child under 13 years old without verification of parental consent, we will delete that information.

We do not knowingly sell or share the personal information of consumers under 16 years of age. If you believe a person under 16 has given us information, contact us and we will delete it.

The Personal Data That We Collect or Process

The categories below are the ones named in the California Consumer Privacy Act (Cal. Civ. Code §1798.140(v)). For each, we describe what it actually means for us. We have collected each of these in the preceding 12 months.

• Identifiers: your name, email address, postal address, telephone number, IP address, and cookie or device identifiers.
• Personal information listed in Cal. Civ. Code §1798.80(e): your name, telephone number, and — if you apply for a job with us — your employment history.
• Characteristics of protected classifications: your date of birth, which indicates your age. We collect this only if you join Samurai Rewards or tell us about a birthday celebration, and we use it only to know when to send your birthday reward.
• Commercial information: records of your visits, reservations, and orders, including reservations you make through OpenTable and orders you place through delivery platforms, where those companies pass the details on to us.
• Internet or other electronic network activity: the pages you view on this website, how you arrived, how long you stayed, and information about your browser and device.
• Geolocation data: the general area you are in, inferred from your IP address. We do not collect precise location from your device.
• Professional or employment-related information: your résumé, cover letter, and preferred location, if you apply for a job.
• Inferences: interest and audience categories that Google Analytics derives from browsing activity.

We do not collect biometric information, education records, or precise geolocation, and we do not collect payment card details through this website. If you pay at one of our restaurants, your card is handled by the payment processor, not stored by us.

Sensitive personal information

We do not collect sensitive personal information as the CCPA defines it in §1798.140(ae) — no government identifiers, account log-in credentials, financial account details, precise geolocation, racial or ethnic origin, religious beliefs, union membership, contents of your mail or messages, genetic data, biometric data, or health or sex-life information. Because we do not collect it, we do not use or disclose it for purposes that would give you a right to limit its use, which is why this site has no “Limit the Use of My Sensitive Personal Information” link.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.

How We Collect Your Personal and Other Data

You Provide Information to Us

We collect information about you when you interact with our Services, such as when you place an order, subscribe for our Samurai Rewards, or make a reservation, or participate in surveys, sweepstakes, contests, or promotions.

Automatically Through Our Services

As you navigate through and interact with our websites, we may use automatic data collection technologies to collect certain information about your equipment and browsing actions. This includes:

• Usage Details & Device Information: Details of your visits to our website, including traffic data, location data, logs, and the resources that you access, as well as information about your computer and internet connection (IP address, operating system, and browser type).
• Cookies and Tracking: We may use "cookies" (small files placed on your device) and web beacons (small pixel files) to help us improve our website, see which pages are popular, and deliver a more personalized experience. You can set your browser to refuse cookies, but some parts of our site may not function properly if you do.

Analytics and advertising technologies: We use Google Analytics and Google Ads, delivered through Google Tag Manager, to understand how guests use this website and to show Shogun advertising on other websites and apps. These use cookies and similar technologies to collect information about your activity on this site over time. We also use Google reCAPTCHA Enterprise on our forms to tell people apart from automated abuse; it collects device and behavior signals for that purpose. There is no Facebook or Instagram pixel on this website, and no advertising technology from any company other than Google. You can stop the advertising use at Do Not Sell or Share My Personal Information.

Information from Third Parties: We may receive information about you from service providers who help us run our business, such as reservation platforms (OpenTable), delivery platforms, payment processors at our restaurants, and our email service (Mailgun). This helps us seat you, fulfill your order, and answer you. We do not buy personal information from data brokers.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal data, to:

• Fulfill Your Requests: To process and manage your table reservations, online food orders, payments, and gift card purchases.
• Communicate with You: To send you administrative notices about your orders or reservations, and to respond to your questions or feedback.
• Improve our Services: To better understand our guests and improve our services.
• Improve and maintain our websites: To analyze how guests use our websites, remember your preferences (like your preferred location), and ensure our websites work correctly on your device.
• Marketing & Promotions: We may use your information to promote our Services, by email to people who asked for it and through advertising delivered by Google. Those advertisements may be targeted based on information collected through cookies or similar technologies about your activity on this site. We do not run advertising technology from any other company on this website.
• Safety & Legal Obligations: To protect against fraud, fulfill our contractual obligations, and comply with any applicable legal requirements.
• Enforce Our Rights: To enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

Who We Disclose Your Information To

We do not sell your personal information — but we do share some of it for advertising

We have not sold personal information for money in the preceding 12 months, and we do not intend to. We have, however, shared some of it for what California law calls cross-context behavioral advertising, and under Cal. Civ. Code §1798.140(ah) that counts as sharing whether or not money changes hands. Saying only “we do not sell” would leave you with the wrong impression, so we say both.

What is shared is not what you type into our forms. It is the identifiers and browsing activity that Google Analytics and Google Ads collect as you move around this site.

You can stop this at any time at Do Not Sell or Share My Personal Information. It takes effect immediately, needs no account, and nothing else about your visit changes. We have not sold or shared the personal information of consumers we know to be under 16 years of age.

Disclosures for a business purpose

Separately from the advertising sharing above, we disclose personal information to companies that perform services for us. In the preceding 12 months we disclosed these categories for a business purpose:

These companies are service providers or contractors: they are contractually restricted to using the information for the service they perform for us, and may not sell it or use it for their own purposes. Beyond them, we may share personal data with the following categories of third parties:

• Affiliates: We may share your personal data with our subsidiaries and affiliates.
• Service Providers: We may share personal data with our contractors, service providers, and other third parties we use to support our organization, such as website support providers, analytics service providers, online ordering and delivery service providers, reservation service providers, email communication service providers, and payment processing service providers. These partners are contractually required to keep personal data confidential and to use it solely for the specific services they provide to us.
• Business Transfers: If our restaurants are sold, merged, or undergo a change in ownership, your information may be transferred to the new owner as part of the business assets.
• Legal Requirements: We may disclose your information if required by law, such as responding to a court order or protecting the safety and rights of our staff and guests.
• Aggregated Data: We may share "de-identified" or aggregated information (data that cannot be used to identify you personally) for industry analysis or local marketing research.

Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act gives you the following rights. You do not need an account to use any of them, and we will not treat you differently for using them.

• The right to know. You can ask us for the categories of personal information we have collected about you, where we got it, why we collected it, the categories we disclosed or shared and to whom — or for the specific pieces of information we hold.
• The right to delete. You can ask us to delete the personal information we have collected from you. We may keep what a law requires us to keep, or what we need to complete a transaction, prevent fraud, or exercise a legal claim — and we will tell you if we do.
• The right to correct. If something we hold about you is inaccurate, you can ask us to fix it.
• The right to data portability. When you ask for the specific pieces we hold, we will provide them in a portable format that you can move elsewhere.
• The right to opt out of sale or sharing. You can stop the sharing of your personal information for cross-context behavioral advertising at Do Not Sell or Share My Personal Information. That one needs no identity check at all.
• The right to non-discrimination. We will not deny you service, charge you a different price, or give you a lower quality of service because you exercised any of these rights.

How to make a request

There are two ways, and both reach the same place:

• Submit a Privacy Request using our form; or
• Call us at (909) 596-9393.

How we verify who you are

Before we hand over or delete anything, we have to be reasonably sure the request is really yours — acting on an unverified request would expose your information to whoever asked. We verify by matching what you tell us against what we already hold, usually your email address and one or two other details. For a request for the specific pieces of information we hold, California regulations require a signed declaration under penalty of perjury, which is part of the form. We ask for no more information than we need to verify you, and anything you send us only for verification is used for nothing else and is not retained.

If we cannot verify you, we will tell you and explain why. For a request to know, we may still be able to respond with categories rather than specific pieces.

Authorized agents

You can use an authorized agent to make a request for you. We will ask the agent for written permission signed by you, and we may still contact you directly to confirm that you gave that permission and that you are who the request says you are.

What happens next

We confirm we received your request within 10 business days, and we respond substantively within 45 days. If we need more time we will tell you before the 45 days are up, and take no more than 45 additional days. There is no charge, unless a request is manifestly unfounded or excessive — in which case we will explain that before doing anything.

We keep a record of each request and how we responded for 24 months, because California regulations require it. That record is used for nothing else.

Global Privacy Control and Do Not Track

Global Privacy Control (GPC). We recognize and honor the GPC signal. If your browser or a browser extension sends it, we treat it as a valid request to opt out of the sale and sharing of your personal information, and we apply it before any advertising technology loads — we read the signal on our own servers as your request arrives, rather than after the page has started running. The opt-out applies to the browser that sent the signal. You can see whether we received and processed it, at any time, on the Do Not Sell or Share My Personal Information page.

Do Not Track (DNT). DNT is a different, older browser setting. No common standard was ever agreed for what a website should do when it receives one, so we do not respond to DNT signals. Use GPC, or the opt-out page, instead.

Other Choices You Have

• Email Marketing: If you joined Samurai Rewards and opted in to marketing email but no longer want it, use the “Unsubscribe” link at the bottom of any email we send. It takes effect on our own systems, not just with our email provider.
• Google Ads: You can opt out of Google's use of cookies or device identifiers for advertising at Google Ad Center (opens in a new window). Our own opt-out at Do Not Sell or Share My Personal Information covers this site specifically.
• Cookies: Most browsers accept cookies by default and let you remove or reject them in settings. Rejecting cookies may affect how parts of this site work.
• Google Analytics: Google offers an opt-out browser add-on at https://tools.google.com/dlpage/gaoptout (opens in a new window).

If You Apply for a Job With Us

Job applicants have the same rights as everyone else. The exemption that once covered applicant information expired on January 1, 2023, and this policy applies to you in full.

When you apply through our careers page we collect your name, email address, phone number, preferred location, résumé and cover letter, and we use them only to consider you for the role and to contact you about it. We do not sell this information, we do not share it for advertising, and we do not disclose it to anyone outside the company.

Applications arrive as email to our hiring address rather than being stored in a database on this website. That does not change your rights — it only means a deletion request is carried out by removing the message and its attachment from our mail, which we do by hand.

We keep applications for four years from the date you apply. California Government Code §12946 requires employers to retain application records for at least that long, so we cannot delete an application earlier even if you ask; we will tell you if that is the reason we are keeping it.

Shine the Light (California Civil Code §1798.83)

California residents may ask a business once per calendar year for a list of the personal information it disclosed to third parties for those third parties' own direct marketing purposes, and the identity of those third parties.

We do not disclose personal information to third parties for their own direct marketing purposes. If you would like that confirmed in writing, write to Shin Nihon Kosan Inc. (d.b.a. Links to Third Party Websites

Our websites may contain links to websites maintained by outside organizations, including third-party social networks (such as Instagram, X, Yelp). Please be aware that these third-party websites are governed by their own privacy policies. Our firm is not responsible for the content or policies maintained by these websites. Please familiarize yourself with the privacy policy of any third-party website you visit, as it will govern any information you submit through that website.

How We Protect Your Personal Data

We take the security of your data seriously. We use a variety of administrative and technical safeguards designed to protect your information from unauthorized access or loss. While we strive to use commercially acceptable means to protect your personal data, please remember that no method of transmission over the Internet is 100% secure.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.

How Long We Retain Your Personal Data

California law requires us to state a retention period for each category rather than saying we keep things for as long as we need them. These are ours:

Changes to Our Privacy Policy

We may update this policy from time to time. We will notify you of any changes by posting the new privacy policy on this page and updating the "Last Updated" date at the top. We review and update this policy at least once every 12 months, as California law requires. We recommend checking this page periodically for any changes.
